Fresh grads too picky.

Not true.

The companies and employers who say that, say that because a lot of fresh graduates they employ quit not too long into their job.

It might be the graduate's fault for not being able to handle real pressure.

Or they might just have been swindled, like I have been.

Two crucial things to look out for in your Contract/ Letter of Appointment.

1. Category of Employment and what it includes

When you're appointed as a say, Marketing Assistant, don't let them give you a 'vague' idea of what you are supposed to do. Make sure, if possible, that what your job entails is LISTED in the contract. Scour your contract for sentences that say shit like 'The employee shall adher to any task and duties given by the employer."

This way, if you were to go to the labour union or whatever, you wouldn't be said as "to have agreed to the employer's terms and conditions."

2. Overtime payment

And since my weasel of a boss just popped into the office, I can't elaborate this in my own words. Here's what I found on lawnet.com.my according to the Employment Act 1955.

Work On Rest Day/Overtime - What is an employee's entitlement?

No employee shall be compelled to work on a rest day unless the employee is engaged to work in shifts.

1. If the employee works on a rest day and is employed on a daily, hourly or other similar rate of pay he shall be paid for the period of work
(i) if the work does not exceed half his normal hours of work, he shall be paid one day's wages at the ordinary rate of pay.
(ii) if he works more than half but does not exceed his normal hours of work, 2 day wages at the ordinary rate of pay.

2. In the case of employee employed on a monthly rate of pay who works on a rest day, he shall be paid for work
(i) if it does not exceed half his normal hours of work, wages equivalent to half the ordinary rate of pay for work done on that day.
(ii) if it is more than half but does not exceed his normal hours of work, one day wages at the ordinary rate of pay for work done on that day.

3. For any work carried out in excess of normal hours of work, the employee shall be paid at a rate which is not less than 2 times his hourly rate of pay.

4. In the case of any employee employed on piece rates who work on a rest day, he shall be paid twice his ordinary rate per piece.
----------------
They might be paying me to learn from them, and I might owe them some sort of gratitude. But I believe that I have paid my dues through the workload and hours that I have put in, and owe them nothing now.
I believe that the main reason why there are so many dissatisfied employees, is because they daren't say anything for fear that they'll lose their current job/ might not get a job in the future for their reputation as a 'difficult' employee.
Also, I want to voice it out to someone of authority but I'm plagued with the internal conflict that despite this weasling out of paying his employees the just amount, and giving them work that isn't their 'scope of work' - I did, and still do a little, think of my boss as a friend.
But friends don't do these things to friends. And he's probably just being nice so that we're blind to all his unscrupulous business methods.
Advice needed:
Should I...
  1. Say something to him
  2. Say nothing, but seek greener pastures
  3. Just stick with the job, because it's probably like this everywhere
  4. Find my greener pasture, then confront him
  5. Something else

In Sg, there are exceptionals in the Employment Acts.

Extracted from www.mom.gov.sg

Who are covered by the Act?

The Act covers every employee (regardless of nationality), including a workman, who is under a contract of service with an employer . However, the Act excludes :-

(a) any person employed in a managerial, executive or confidential position;

(b) any seaman;

(c) any domestic worker; and

(d) any person employed by a Statutory Board or by the Government.

Most grads (unfortunately) come under (a)

Personally, I don't believe in confrontation coz Sg is such a small place/community. Somehow someday, u will get to bump into each otehr again. So better to maintain a cordial relationship especially if u r still new in the job-mart.

(2) is safe move. If you are really unhappy, then better look for something u won't drag everyday!

You have this too!!

from lawnet.com.my

1. "Employee" under the Act means:-

a) any person whose wages does not exceed RM1,500.00 per month under a contract of service with an employer.

Surely u r getting more than that, right?

button.. i'm workinig in Malaysia lah.

and not, i'm not getting more than that.

and the reason for my ranting, is because I get RM5 per hour for my O.T. That's it. Not on top of basic or whatever. Just RM5/ hour.

They have a point about not burning your bridges - Kuching IS a small town.

It's hard to deal with this thing in Malaysia.

Is your boss approachable? If so, have an informal chat with him about how overworked you feel - just to test the waters. If he seems open, then a formal letter requesting better pay / better OT (hopefully referring to company policy) may be a good idea.

if he's not receptive at all, or shuts you down, then screw it - find another job. Or come and be my disciple! *grins*Z

Successful people have patience even when they are forced to start from scratch. The M'sian economic outlook is not too good, so you should be thankful to be employed as your a fresh grad. So have patience, stay around for a year, gain that crucial workign experience and you can leave then.

-patient worker-

err... my 2 cents worth which is pretty crappy since im a freshy like u:

1. try politely. did this with my last boss but he flamed me. frigging asshole of a jap bastard.

if your boss is a monster, keep quiet.

2. greener pastures are rarely as green as they look once there. but it's alway good to keep looking till u hit the right one.

3. if it's mentally stressing and demoralizing, get the hell out. u dont deserve that. u deserve better.

4. no. find greener pastures n move on.

5. go skydiving hehe

take care man! don't allow yourself to get ripped off. cheers
